Really stupid idea. Apple?
I first thought it was already April 1st and I had somehow missed Winter, but it seems this really _is_ part of a patent application: Apple wants to put the optical drive at the _bottom_ of the next, smaller, MacBook revision. This has to be one of the most stupid ideas ever to come out of Cupertino. Really: If the optical drive is _so_ unnecessary, I say just get rid of it altogether. But I happen to need it sometimes. You know: Rip an audio CD, burn a data CD - some users even use their Macs with iLife to create movies and music and the likes. They might need access to the drive as well...

You're talking about a very specific use that does _not_ seem to be at the core of this patent. You're right in that miniDVDs and CDs of abnormal forms can't be played in current Apple notebooks, but it's by and large a forgettable problem.
The Diagrams show the old Ti Powebook which gives us an idea of how old this idea was.

Yes, I'd say the attention this patent application got was a bit too high, then. This might simply be one of the attempts to make the TiBook even thinner than it was - and may have already seen that Apple didn't make use of the idea for an endproduct.
On the other hand, it has been brought up that this might be used in a different product like a tablet, where it might play less of a role whether you have to turn the device upside down. (I personally even there would doubt it'd make much sense, though.)
